Up until August 15, 2010, New York only allowed fault-based divorces. The allowable grounds for divorce differ from state to state, but New York used to require the party petitioning for divorce to accuse the other of a fault such as adultery or abandonment for a period of one year or more. A new Act was signed into law in 2010 that permitting New York residents to file for divorce without accusing their spouse of a fault.
This is called "no-fault divorce" and according to Domestic Relations Law (DLR) § 170.7, if the husband and wife's relationship had "broken down irretrievably for a period of at least six months" then a divorce can be granted. With the addition of the no-fault divorce provision, there are now a total of seven actions for divorce allowable in New York State.
